Welcome to Miss Kindred’s House (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of our website, products, and services, including the Listening Library, downloads, communications, and any communities we host (collectively, the “Services”).

By accessing or using the Services, you agree to these Terms and to our Privacy Policy (linked on our site). If you do not agree, please do not use the Services.

2) Memberships, Subscriptions, and the Free Sampler

Free Sampler (no cost). You may join the Miss Kindred Community and access the sampler without payment. No credit card is required. You can unsubscribe from emails at any time via the link in our messages.

Paid Memberships. We offer paid plans that grant access to additional materials (e.g., the Listening Library, downloads).

California & other renewal disclosures: We clearly disclose pricing, term length, and renewal terms at checkout, and we provide easy cancellation through your account settings and/or by contacting hello@miss-kindred.com.

4) License to Use the Services

Subject to these Terms and your timely payment (if applicable), we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes.


5) Your Content & Community Guidelines

You may submit content (e.g., comments, reviews, questions). You retain ownership of your content, but you grant us a worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute it for operating, promoting, and improving the Services.
You agree not to post content that is unlawful, harassing, hateful, misleading, infringing, or that violates privacy or publicity rights. We may moderate, remove, or restrict content or accounts at our discretion to keep the community safe.

Miss Kindred’s House provides general educational and wellness-oriented content for caregivers and educators. We do not provide medical, psychological, therapeutic, legal, or other professional advice. Always consult qualified professionals for guidance specific to you or your child. If you believe someone is in danger, call local emergency services immediately.


8) Children’s Privacy

Our Services are directed to adults (parents, caregivers, educators). We do not knowingly collect personal information from children under 13. Do not submit a child’s personal information through the Services. If you believe a child has provided personal information, contact hello@miss-kindred.com and we will delete it.


9) Intellectual Property

All content and materials on the Services—including audio, text, graphics, logos, names, images, videos, design, and software—are owned by us or our licensors and are protected by intellectual-property laws. All rights not expressly granted are reserved.

We may link to or integrate with third-party websites or services (e.g., payment processors, email platforms). We are not responsible for third-party content, policies, or practices. Your use of third-party services is governed by their terms.

By joining the free sampler or purchasing a membership, you may receive service, transactional, or promotional emails. You can unsubscribe from promotional emails at any time via the link in our emails. (You may still receive essential transactional messages, such as receipts or account notices.)

We aim to make our content accessible. If you encounter a barrier, please email hello@miss-kindred.com and we’ll work to provide an accessible alternative.


13) Termination

You may stop using the Services at any time. We may suspend or terminate access if you materially breach these Terms, harm the community, or misuse the Services. Upon termination, your license ends and you must stop using our content; sections that by nature should survive (e.g., IP, disclaimers, limitations of liability) will continue to apply.


14) Disclaimers

The Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and any warranties arising out of course of dealing or usage of trade. We do not warrant that the Services will be uninterrupted, error-free, or secure.


15) Limitation of Liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use of or inability to use the Services; (b) any conduct or content of any user or third party; or (c) unauthorized access, use, or alteration of your content. Our aggregate liability for any claim related to the Services will not exceed the amount you paid to us for the Services in the three (3) months preceding the event giving rise to the claim (or $50 if you used only free Services).

Some jurisdictions do not allow certain limitations; in those cases, the above limitations apply to the maximum extent permitted.

You agree to indemnify and hold us harmless from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your content, or your violation of these Terms or applicable law.


17) Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. You agree to submit to the personal jurisdiction of the state and federal courts located in Sacramento, California, for any dispute that is not subject to arbitration (if applicable).

Optional: If you want binding arbitration and a class-action waiver, ask your attorney to add a compliant clause tailored to your state’s laws.


18) Changes to the Services or Terms

We may update these Terms from time to time. When we do, we’ll change the “Effective date” above and, for material changes, provide notice (e.g., by email or site banner). Continued use of the Services after changes become effective means you accept the revised Terms.
